At the resumed sitting in Calabar on Monday, the court submitted that the appellant who failed to file his processes on time before the court, had no reason to appear before the court and thereby struck out the matter.

The implication of the decision of the appellate court which was presided over by their Lordships, Justice R.C, Agbo, O.F, Omoleye and B.B, Aliyu is that the matter has been laid to rest once and for all as the hope of seeking further redress has been dashed by the action of the appellant at the Appeal Court.

The victory of Hon. Mike Etaba means that all legal tussles against his candidacy has come to a positive end especially as the National assembly hopefull is counting weeks to elections.
